Please read this acceptable use policy (“policy”, “AUP”) carefully before using any products furnished by Parapluie Creative. This policy applies to any products you have been given access to by parapluie creative, so long as those products reside on a server owned and/or operated by Parapluie Creative. 

Services provided by us may only be used for lawful purposes. You agree to comply with all applicable laws, rules, and regulations in connection with your use of the services. Any material or conduct that in our judgment violates this policy in any manner may result in suspension or termination of the services or removal of the user’s account with or without notice, and without refund. In the event of total service termination, you will be provided with a complete system image of the server for your use with another provider. Parapluie will work with the other provider to ensure the complete and accurate transfer of all user data. Additional fees may apply for this service.

Prohibited use

You may not use the services to publish content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject us to liability, including, without limitation, in connection with any of the following, each of which is prohibited under this AUP:

• Phishing or engaging in identity theft
• Distributing computer viruses, worms, trojan horses or other malicious code
• Distributing pornography or adult related content or offering any escort services
• Promoting or facilitating violence or terrorist activities
• Infringing the intellectual property or other proprietary rights of others

Additionally, as a provider for services intended for business use, we prohibit the following types of content:

• Content that is in violation of any portion of the British Columbia Human Rights Code, including content that may be discriminatory (as defined by the act)
• Content that may be libellous or slanderous against another person or business, or other form of entity.

If you are using our services to sell a product or service, you may not sell or provide the following types of businesses, without our express, written consent:

• Tobacco, or Tobacco like products, such as vapor products.
• Cannabis or cannabis related products
• Illegal drugs or drug paraphernalia
• Unauthorized ticket sales
• Pharmaceutical products, or pharmaceutical-like products making medical claims not certified by a government agency.
• Weapons or Weapon Accessories. 
• Food Products without a license from applicable government food safety authorities. 

Enforcement

In the event of a takedown request under the Digital Millennium Copyright Act, the following section will not apply, and we will abide by the request from the copyright holder. We will stand by and protect your rights under the Notice and Notice requirements, and will deny any fraudulent or unsubstantiated DMCA takedown requests. We are legally obligated to abide by lawful takedown requests under the Digital Millennium Copyright Act.

In the event of a violation of this policy, the alleged infringing content will be removed, and you will be contacted to assist in the correction of the infringing content. If infringing content is continued to be posted, Parapluie may take action including but not limited to:

• Disabling user accounts you have access to, and removing your access to the services.
• Permanently deactivating services altogether without refund.
• Temporarily deactivating services without refund, until the content is removed.
• Removing offending content ourselves.

In any of these events, you will be provided a notice by e-mail, and by Registered Mail to the address on file. You will have 14 days from the date of delivery of the document by registered mail to remedy the infringing content. 

If you feel that your content does not violate this policy, you may contest the notice by filing a ticket within 48 hours, by emailing helpme@parapluiecreative.ca.

We reserve the right to change this policy at any given time, of which you will be promptly updated. In the event of a change to this policy, you will be provided 30 days notice before the changes will take effect.
